PERSONAL DATA and PRIVACY POLICY

This Personal Data Privacy Policy (“Policy”) formulated in accordance with the Personal Data Protection Act 2010 (“Act”). POSIM PETROLEUM MARKETING SDN BHD 198501007134 (139576-M) (“POSIM”) is mindful and committed to the protection of your Personal Data (“Personal Data”) and your privacy.

(A) Collection of Personal Information

In order for us to provide you with our Product and/or Services and to operate in an efficient and effective manner, we may need to collect relevant Personal Data as defined in the Act from you either manually or through our website, social media or other communication channels. Personal Data collected by us include but is not limited to:

The failure to supply such Personal Data may:-

Result in us being unable to provide customers/prospective customers with the notices, services and/or products requested; and/or

B. Purposes of Processing

POSIM processes Personal Data mostly for business purposes. These purposes may include but not limited to the following:

To process applications for and the provision of POSIM’s Products and/or Services

For any other lawful purposes in relation to our activities/operations as permitted by the Act and applicable laws/regulations

POSIM may disclose Personal Data to our affiliates or third parties that perform services on POSIM’s behalf and in doing so we will comply with all applicable laws, regulations and industry standards.

D. Acceptance of The Policy

You are given notice that the Products and/or Services will only be made available to you upon your accepting and expressly consenting to the terms of this Privacy Policy, where such express acceptance and consent shall be evidenced by you clicking or checking or indicating accordingly on the relevant consent portion of the registration forms or such other documents as may be furnished to you, as the case may be.

By so indicating your acceptance of the term of this Privacy Policy, you shall be deemed to have expressly consented to the processing of Personal Data by POSIM or any of its authorized agents, employees, partners and/or contractors for purposes as outlined.

You hereby agree and accept that by registering and/or continuing to use the Products and/or Services, you authorize and consent to Personal Data being processed by and where required, disclosed to classes of third parties as identified by POSIM for the purposes of POSIM providing the Products and/or Services in accordance with the Act.

E. Marketing and Promotional Purposes

Our promotional alerts/materials, newsletters, updates, mailers, special privileges, festive greetings, on those of our partners, sponsors or advertisers

F. Withdrawal of Consent

Notwithstanding anything to the contrary, you may at any time withdraw your consent to POSIM processing any Personal Data or to any part or portion of the same by sending to POSIM at the address set out below a written notice of withdrawal and within the period prescribed under the PDPA. POSIM shall take all necessary measures to give effect to your withdrawal of consent, to the extent that such withdrawal does not conflict with any of POSIM’s other legal obligations.

If you do not wish to have your personal data shared with any other party, or if you do not wish to be solicited for products or services offered by POSIM or any other parties including third parties, kindly forward us your written request to the contact details as provided below.

You shall, upon written request, be granted access to Personal Data held or stored or processed by POSIM. To avoid confusion, “access” for the purposes of this provision shall mean notification of such personal data of yours that is processed by or on behalf of POSIM and to have a copy of such personal data communicated or conveyed to you in an intelligible form of POSIM’s choosing.

G. Correction of Personal Data

You may at any time make a written request directing it to the same contact details as provided below to correct any/or update Personal Data that is inaccurate, incomplete, misleading or out-of-date and POSIM shall, upon receipt of your written request for correction(s), take all necessary measures to give effect to such correction(s).

RETURN AND REFUND POLICY

General

1. This policy is only applicable to Products purchased through our HI-REV Junction Webstore (as defined in the Terms and Conditions).

2. You may request for a refund of the Product purchased under the following circumstances:-

2.1 the Product is substantially different to the image on the Portal;

2.2 the Product is faulty;

2.3 incorrect Product was received;

2.4 the Product is damaged on arrival; or

2.5 non-receipt of the Product purchased.

Request for a refund shall be made via our hrj_webstore@posim.com.my under the Return and Refund Category. Request for a refund is subject to the terms and conditions in this policy.

3. We do not accept any exchange of Product. You can only return the Product, at your own cost and risk via courier, to the following Return Address :

Condition of Product to be returned

4. Please return to us the Product in the following condition, within fourteen (14) working days of the Product being received by you at your nominated address:-

4.1 in its original condition;

4.2 unused, (unless to use the product will require installation/DIY); and

4.3 in its original packaging, with the price tags, wrappings, box, and accessories (if any) still attached.

Refund Procedure

5. All returns must be made via traceable courier to the above Return Address and use the downloaded Returns Form. The original proof of postage must be kept and produced if and when requested.

6. You are solely responsible for the delivery risks and condition of the Product to be returned until it reaches us at the Return Address. We will not be liable for any loss or damage prior to the Product's arrival at the Return Address. You are advised to package the Product to prevent any loss or damage to the Product or its box. Please ensure all Products are returned in their original packaging.

7. The return of a Product does not amount to an automatic refund by us. If you return the Product we will examine the returned Product to determine whether you are entitled to a refund by considering amongst others, whether the Product is in the condition as set out in Clause 4 (as applicable) and we will inform you of our decision within a reasonable period of time.

8. Any justified refund will include the delivery charges paid by you for delivery of the Product to you, the delivery charges amount shall not exceed the original charges incurred when product delivered to you.

Cancellation of Order

9. If you cancel your order but we have already processed the Product for delivery to you, please do contact our Customer Service team immediately in order for us to confirm if a cancellation, stop or refund is possible. Should the Product leave our warehouse and is not able to be retrieved back, you must not unpack the Product when it is received by you and you must send the Product back to us at the Return Address at your own cost and risks within 2 working days from the dateof the Product received.

10. Once you have notified us that you are cancelling your order, any sum debited to us from your credit card or other financial payment gateway will be re-credited to your account as soon as it is practicable for us to do so PROVIDED THAT the conditions in Clauses 5 to 9 above as are required of you are met. If you do not return the Product delivered to you or do not pay the costs of delivery of the returned Product, we shall be entitled to deduct the said costs from the amount to be re-credited to you.

Miscellaneous

11. We will refund using the same method originally used by you to pay for your purchase.

12. As it is our policy to endeavour to process orders immediately, it may not always be possible to stop an order from being despatched after your cancellation/request for a return and refund. After despatch, this policy will apply.

13. We may review and update this policy from time to time to reflect changes in the law and changes in our business practices, procedures and structure. While it is not generally feasible to notify you of changes to this policy, the latest version of the policy may be available on our Portal.

SHIPPING TERMS

General

Delivery service is currently restricted to locations within Peninsular Malaysia only.

Our current delivery charges per consignment are standardised to RM8.00 for the first 1 kg, with an additional RM1.50 being charged per subsequent 1 kg. All delivery charges are subject to 6% Goods and Services Tax (GST).

Delivery charges for orders will be calculated based on either the volumetric weight or actual weight of the parcel, whichever of the two is higher, unless stated otherwise.

Volumetric Weight

Shipping costs can be affected by the amount of space a consignment occupies, rather than the actual weight. This is the volumetric (or dimensional) weight. The volumetric weight of a shipment is a calculation that reflects how dense a package is. A low density package generally occupies a greater volume of space, in comparison to its actual weight.

The volumetric or dimensional weight is calculated and compared with the actual weight of the shipment to ascertain which is greater; shipping costs are calculated based on the higher weight.

The formula used to determine volumetric weight for our consignments is given below:

Volumetric Weight(kg) = Length(cm) x Width(cm) x Height(cm) / 5000 (Volumetric Divisor)

Products purchased are delivered within 4 to 10 working days within Malaysia.

As e-voucher products are immediately sent to your e-mail, returns/exchanges are not available. Please take note of this before purchase, and input your e-mail address correctly.
